Terms and Conditions
Please read our installation and service agreements carefully.
1. Quotations, Payments, and Ownership
Quotation Validity
All quotations are valid for 14 days from the date of issue.
Payment Terms
For the installation of new shade sails and posts:
- A 50% deposit/progress payment (comprising 10% deposit plus a 40% progress payment) will be invoiced together upon acceptance of the quote for your custom-manufactured shade sail.
- The balance is due on installation day.
Acceptance of Terms
Your deposit or payment confirms acceptance of all terms and conditions outlined here.
Ownership of Goods
All goods remain the property of the contractor until paid for in full.
2. Site Access and Installation
Site Access
The customer must provide full access to power, water, and the site for the duration of the installation.
Additional Costs
The customer is responsible for any unforeseen costs incurred due to obstructions encountered during installation (e.g., rocks, concrete, underground services). It is recommended to use the “Before You Dig” service to obtain a site report prior to commencement.
Soil Removal
Soil removal is not included in the quoted price. If required, soil removal will be charged as a Provisional Sum of $350, covering labor, ute/trailer costs, and tipping fees.
House Structure
Quotes are based on timber-framed houses and tiled roofs unless otherwise specified.
Delays
The contractor is not responsible for delays caused by:
- Material shortages (e.g., steel posts, shade fabric, fixings).
- Weather conditions, such as rain, wind, or inclement weather.
- Government regulations, restrictions, staff shortages, or other external factors beyond the contractor’s control.
Delays may extend the installation period without prior notice.
3. Design, Engineering, and Approvals
Building Approvals
The customer is responsible for obtaining any required building approvals, including local council, state or federal government approvals, engineers’ certificates, or body corporate approvals, along with any associated fees. Engineering and certification are not included in any quote unless otherwise stated.
Project Changes
Any amendments or changes to the project during installation (e.g., repositioning of posts or fixings) may incur additional charges and will be invoiced accordingly.
Design Disclaimer
All visual measurements, designs, and layout features provided prior to installation are indicative only. Final placement and design may be subject to change based on actual on-site conditions, including but not limited to ground levels, roof heights, structural access, and the presence of underground services. These variables cannot be fully assessed until work has commenced. The contractor reserves the right to make necessary adjustments to ensure structural integrity and suitability of installation.
Sail Design & Curvature
All shade sails are designed and manufactured with a curved perimeter. This is an essential feature of proper shade sail design and is required to achieve correct tension, structural integrity, and performance of the sail. The larger the sail, the more pronounced this curve will appear. This curvature is not a defect or design flaw, but a standard and necessary aspect of shade sail construction. By proceeding with an order, the customer acknowledges and accepts that their completed shade sail will include this design feature.
4. Warranties and Maintenance
Workmanship Warranty
A 12-month workmanship warranty applies to new installations.
Warranty Exclusions
The warranty does not cover extreme weather conditions, such as gale-force winds, hail, or storms. It is recommended shade sails are removed ahead of forecast extreme weather events.
The warranty also excludes site conditions (such as inadequate drainage), damage, or faults resulting from neglect, misuse, or failure to maintain the shade sail, structure, or associated components. Customers are required to carry out reasonable and regular maintenance checks and report any concerns as they arise. Delays in addressing emerging issues may void warranty coverage.
Customers must adhere to the maintenance guidelines outlined in the official maintenance manual: Maintenance Guide (Rainbow Shade).
Fabric Supplier Warranty
Shade fabric warranties provided by the supplier: Rainbow Shade Z16: 10 years; DriZ: 5 years; Extreme 32: 15 years.
The Z16 and Extreme 32 Shade Fabric warranty covers customers where the fabric has degraded due to exposure to sunlight. The warranty does not extend to the following instances:
- Damage to the fabric caused by abrasion or mechanical means.
- Damage which may occur due to faulty design or installation (tears, wear, friction damage, holes).
- Colour fading.
- External chemical damage by the use of damaging chemical cleaning agents and chemical products.
Maintenance
Shade sails are flexible structures. Fixings and mountings should be inspected regularly to ensure they remain in good condition.
5. General Conditions
Use of Property Photos
By accepting these terms, you grant the contractor permission to use photos of your property for marketing purposes, including on the internet and social media.
Additional Terms and Exclusions
- All works are subject to engineering approval and final certification where required.
- Quotation is subject to final design parameters and may be adjusted based on site-specific requirements.
- It is assumed that existing structures (where shade sails or posts are to be attached) are of adequate structural integrity. Sunny Coast Shade Sails accepts no responsibility for the failure of existing infrastructure.
- Standard insurances, including Workers’ Compensation (where applicable), Public Liability, and Motor Vehicle insurance are included. No additional insurance coverage beyond these has been allowed unless otherwise stated. Insurance cover is provided through Allianz.
- Quoted works are subject to unrestricted site access to allow continuity of installation. Delays or additional costs arising from restricted access may result in additional charges.
- Repairs or “make good” to existing ground surfaces are not included. The use of heavy machinery may result in some disturbance or cosmetic damage (scratches, chips, scuffs). Due care will be taken to minimise this, but Sunny Coast Shade Sails does not accept responsibility for incidental damage.
- Additional costs may be incurred where unforeseen or unknowable site conditions are encountered, including but not limited to inadequate drainage, underground structures or infrastructure, or other environmental factors.
- Prices are subject to change if raw material costs increase, including during the production phase, as material markets are highly volatile.
- Prices are also subject to revision if the USD–AUD exchange rate fluctuates by more than 5% from the date of the quote.
- Provisional sums are estimates only. Final costs for these items may vary upon product selection and confirmation at contract award.
